General Terms and Conditions

Upon sending an order, you accept the general terms and conditions stated as follows. Please read them thoroughly. If you do not agree with individual points of the general terms and conditions or do not agree with them as a whole, please do not place your order. Sales and deliveries shall only be carried out on the basis of the acceptance of our general terms and conditions stated as follows.

Our general terms and conditions shall exclusively apply in the version valid at the time of ordering for all business relationships between Casa Bruno S.L. (hereinafter referred to as Casa Bruno Online Shop) and the customer.

If individual conditions should be ineffective or should become ineffective due to circumstances occurring at a later date, the effect of the remaining terms and conditions shall remain unaffected.

Realization of the purchase agreement

Information stated by us regarding goods and prices within the ordering process are subject to confirmation and non-binding.
With your order you submit a binding offer. This offer will be accepted by Casa Bruno Online Shop, insofar as and as soon as an order number is assigned to the offer and you receive confirmation of same from us by e-mail. Ordering takes place by the purchaser sending the fully completed online order form provided by Casa Bruno Online Shop. The contract is concluded by the order confirmation being sent. Casa Bruno Online Shop reserves the right to withdraw from the delivery of the offered goods in the event of a lack of availability. A claim to delivery of the goods only arises when the offer has been accepted.

After sending your order, you will automatically receive confirmation by e-mail. Upon receipt of the order confirmation, a legally valid purchasing agreement has been concluded, which can be cancelled within 14 days without stating the grounds for the cancellation. Commencement of the term begins upon receipt of the goods.

Prices

All prices stated in EUR or Euro are gross prices and contain the VAT legally valid in Spain. All offers are subject to confirmation. Price changes on the grounds of changed purchasing conditions reserved. As soon as new prices are stated, all former prices lose their validity. For short-term quotations, attention shall be paid to the period of validity. For all ordered products, the price stated upon this date shall be valid including the statutory VAT and excluding shipping charges.

Firms or companies (outside Spain) with a valid European VAT ID number shall not be subject to VAT.

Statutory VAT shall not be calculated for deliveries outside the EU (Norway, Switzerland, Liechtenstein, Canary Islands and non-European countries). This shall be deducted upon invoicing. If export or import fees are due during the shipping process, they shall be borne by the purchaser. Errors and price changes excepted.

Methods of payment

Payment shall take place in accordance with the method stated on the online order form.

If advance payment by bank transfer has been agreed upon, you will receive a confirmation e-mail with our bank details after placing your order. After payment has been received, the goods will be shipped without delay. Please observe the stated delivery dates.

Delivery

After receiving your offer and following confirmation by Casa Bruno Online Shop, delivery shall take place as soon as possible, usually within 1 to 3 workdays after order confirmation. In case of advance payment having been agreed upon, shipping takes place by Casa Bruno Online Shop following the day of payment. Unfortunately, we have no influence on bank processing times and delays in delivery caused by the transport company.
We are entitled to make partial deliveries. In the event of partial delivery, we shall of course bear the additional shipping costs involved. We deliver to the address stated upon order placement. Sending of the goods takes place at the sellers risk. The risk for the ordered goods is only transferred to the purchaser upon delivery of the goods.
We shall not be liable for delays in delivery caused by our sub-suppliers, and these shall not represent grounds for damage claims or cancellation of the contract.
The customer commits himself to diligently inspect our deliveries immediately upon arrival. Transport damage shall be reported to the responsible transport company and be confirmed by same in writing. The goods will only be insured by us upon explicit customer request.

Shipping costs

Shipping to destinations within Spain shall take place free of charge.

For shipping within the EU, Norway and Switzerland: free shipping of orders exceeding a goods value of 500 Euro. All deliveries with a goods value of less than 500 Euro are subject to a lump shipping cost to the amount of 30 Euro per delivery.

Please contact us for information on shipping costs to countries outside the EU.

Right of rescission and returns

You are entitled to e right of rescission. As a consumer, you are no longer bound to your order if you cancel it in writing within a period of 14 days after receipt of the goods. The cancellation must not state grounds and can be made in writing (e.g. per e-mail to sales@casabruno-shop.com) or by returning the goods.

Sending the goods within the allowed period or the declaration to the address of Casa Bruno Online Shop stated below shall be deemed sufficient for keeping the term. In the event of a simple cancellation declaration, you must also return the goods to us in their original packaging.

We reserve the right to undertake further steps if these goods show traces of use or damage. You can avoid this by simply inspecting the goods as you would have been able to do in any shop. Casa Bruno Online Shop reserves the right to demand appropriate compensation for damages or soiled packaging, and for incompletely returned or used goods.

Customised designs are excluded from replacement and return.

In the event of rescission, the punctual return of the goods in the original packaging shall be deemed to be sufficient for keeping the term. Please return the goods to:

Consequences of rescission

In the event of an effective rescission, reciprocally rendered services shall be returned and possible benefits submitted. If the received services cannot be returned in part6 or in full, or can only be returned in a deteriorated condition, adequate compensation shall be granted, if applicable. This does not apply if the deterioration of the goods can be attributed to their inspection as you would have been able to do in any shop. Apart from that you can avoid the compensation obligation by not putting the goods into use as your property and by avoiding any action which may be detrimental to their value. Fees for payment are not returnable.

You must bear the cost of the returned delivery if the delivered goods complied with those ordered.

Retention of title

The delivered goods remain our property until fully paid for. The purchaser is not entitled to resell the goods until they have been paid for in full. In the event of insolvency of the customer, we are entitled to demand the return of the goods or may have the goods picked up at the customer's expense. The purchase price shall remain still be due. The cancellation charge is 30% of the agreed purchase price. The prerequisite for all previously mentioned points is that the goods are unused and in their original packaging.

Data protection

We used the personal data of the purchaser for handling and fulfilment of the contract or for tax purposes only. We send our goods by post, haulage company or parcel service. These contain only such information required for shipping.
